Justice Samuel Alito 'fell ill' during Federalist Society dinner

Justice Samuel Alito he was hospitalized during a Federalist Society event in Philadelphia last week, CNN reported.

CNN said that his "falling ill" was "an isolated incident," but noted it's part of the question about whether Alito will resign during President Donald Trump's second term. It would mean four of the nine members of the Supreme Court were installed by Trump.

"The justice was evaluated and administered fluids for dehydration. He returned to his home in Virginia that night with his security team," said the report.

Democrats are currently aiming to take back the House, which is appearing increasingly likely according to experts and pollsters. The battle for the U.S. Senate is a heavier lift. Democrats would need to defeat two Republicans and retain all incumbents. It's possible, particularly in North Carolina and Maine.

If Democrats win the Senate, however, they could use similar tactics deployed by Sen. Mitch McConnell (R-Ky.) to leave the seat vacant until after the 2028 election.

The 76-year-old Alito has been on the court for 20 years after being appointed by President George W. Bush.

"Close friends of Alito have told CNN that he has contemplated retirement, but that no decision seems imminent," the report added.
