Apple está impugnando la nueva ley de sanciones antimonopolio de la India, que expone a la empresa estadounidense a una multa de hasta 38,000 millones de dólares, según una presentación judicial ante el Tribunal Superior de Delhi a la que Reuters tuvo acceso.

La impugnación es la primera a la ley de sanciones antimonopolio de la India, que desde el año pasado permite a la Comisión de Competencia de la India (CCI) usar el volumen de negocios global a la hora de calcular las sanciones que impone a las empresas por abusar de su posición dominante en el mercado.

Desde 2022, Match, propietaria de Tinder, y otras empresas indias, se ha enfrentado en una batalla antimonopolio contra Apple en la CCI. Los investigadores emitieron el año pasado un informe en el que dijeron que la empresa estadounidense de teléfonos inteligentes había incurrido en una "conducta abusiva" en el mercado de aplicaciones de su sistema operativo para iPhone, iOS.

La CCI aún no ha tomado una decisión definitiva sobre el caso, ni siquiera sobre las sanciones.

La "máxima sanción" a la que se expone Apple, una tasa del 10% de su facturación global promedio derivada de todos sus servicios durante tres ejercicios fiscales hasta 2024, podría rondar los 38.000 millones de dólares, según la demanda. Tal "sanción basada en el volumen de negocios global (...) sería manifiestamente arbitraria, inconstitucional, desproporcionada e injusta", añade el documento.

En la Unión Europea, las empresas también se arriesgan a multas de hasta el 10% de su facturación global por infracciones antimonopolio.

Apple y la CCI no respondieron a solicitudes de comentarios.

Meanwhile, earnings across other developed markets barely touched 2%. That gap helped push the decision to drop international holdings in favor of American ones. Michael Gates, lead portfolio manager for BlackRock’s Target Allocation ETF model portfolio suite, said the US market is the only one showing consistency in sales growth, profit delivery, and revisions in analyst forecasts. “The US equity market continues to stand alone in terms of earnings delivery, sales growth and sustainable trends in analyst estimates and revisions,” Michael wrote.
