US Trade Faces Disruption After Tariff Ruling

According to reports, conflicting developments in President Donald Trump’s tariff regime have thrown aspects of US trade into confusion. Following the Supreme Court’s ruling, striking down Trump’s duties, the administration maintains that its trade policy is unchanged, adding a new 15% global tariff.

The Government Has Not Implemented the Court’s Ruling

In the meantime, it is worth noting that the US Customs and Border Protection (CBP) has yet to update its systems to comply with the Supreme Court’s judgment, which said the president lacks the legal authority to impose comprehensive import tariffs.

Complications Arise in the US Trade Ecosystem

The US generated billions of dollars from Trump’s tariff implementation, with the duties embedded directly into the CBP’s electronic systems. Those duties were also embedded into the cargo-tracking and tariff-classification tools deployed at ports of entry across the US borders.

Notably, the Supreme Court’s ruling that the IEEPA does not give the president the power to install tariffs automatically removed the legal basis for those duties. The ongoing mix-up has complicated certain processes for businesses, particularly importers who are experiencing shipment delays and the possibility of paying invalid duties.

Trade Bodies State Their Position

In the meantime, several businesses have begun lodging protests and corrections of entries with the US Customs, while others wait for updates in the tariff codes before moving their goods. Trade bodies expect the US CBP to act quickly to prevent further delays in supply chains, which would cause products to reach their destinations late. 

According to the stakeholders, governments often need to invest time and adjust their technologies and systems to accommodate legal decisions from the courts.
