- This MEXC VVIP and M-Score Services Agreement (“Agreement”) is a contract between you (“you”, “your” or “User”) and MEXC (“we”, “our”, “us” or “MEXC”). It sets out the terms and conditions that govern your use of MEXC’s M-Score Service and related trading services through MEXC.com or any of our associated websites, application programming interfaces or mobile applications (collectively the "Platform").
- The terms and conditions in this Agreement are supplementary to the User Agreement, Privacy Policy, Risk Disclosure or any such other agreement or publication pertaining to MEXC’s M-Score Service or related trading services as may be published by MEXC from time to time (collectively, the “Legal Documents”). If the terms in this Agreement vary from that of the Legal Documents, the terms in this Agreement shall prevail. Before you use our M-Score Services and related services, you should read this Agreement and the Legal Documents carefully.
- By using MEXC’s M-Score Services and related trading services (the “Service” or “Services”), you are deemed to have read, agreed, and fully understood the terms and conditions of this Agreement and the terms set out in the Legal Documents (including any revisions as may be published by us from time to time). If you do not agree to any terms or conditions set out in this Agreement or the Legal Documents, you are hereby advised to cease your use of the Services immediately. By continuing to use the Services, you are deemed to have agreed to the terms and conditions set forth in this Agreement and the Legal Documents in their entirety unconditionally.
- Please note that certain users residing in specific jurisdictions may not access the Service, which may include North Korea, Cuba, Sudan, Syria, Iran, Mainland China, Singapore, the United States, the United Kingdom, Hong Kong, Russian-controlled regions of Ukraine (currently including the Crimea, Donetsk, Sevastopol, and Luhansk regions), and Canada (altogether referred to as 'Prohibited Countries'). The above list is non-exhaustive in nature and may be subject to unilateral changes by MEXC without prior notice to you.
1. INTRODUCTION AND BENEFITS
1.1 Nature of M-Score
M-Score is a comprehensive and dynamic credit-based service designed to provide eligible Users with enhanced trading capabilities, personalized benefits, and value-added features on the MEXC Platform. It operates on a proprietary M-Score evaluation system that assesses Users’ credit worthiness through multi-dimensional data analysis, which may include but not limited to your trading activity, engagement, and account security, enabling MEXC to tailor services to individual risk profiles and engagement levels. A higher M-Score generally means you may unlock even more privileges. Specifically, M-Score serves as a bridge between Users’ platform behavior and premium services, offering a tiered benefit structure that rewards consistent, compliant, and active participation in the MEXC ecosystem. In addition, M-Score points can also be obtained by participating in designated platform activities. User tiers under the MEXC VVIP system correspond to specific M-Score thresholds—Users who meet or exceed the prescribed M-Score threshold may be upgraded to the corresponding higher tier.
1.2 M-Score Benefits
By accessing M-Score, the actual benefits you may enjoy are subject to the descriptions on MEXC’s M-Score Service display page. MEXC reserves the right to adjust such benefits from time to time at its sole discretion, subject to your M-Score, risk assessment results, and compliance with this Agreement.
1.3 Independence of M-Score Services
MEXC’s M-Score Services is an independent service. Unless otherwise agreed herein or supplemented by a subsequent written agreement or explicitly stated in a separate agreement between MEXC and you, the M-Score obtained by you pursuant to this Agreement shall not be deemed or used as a basis for you to claim rights or interests in other products or services of MEXC.
2. DEFINITIONS

2.0 MEXC VVIP | “MEXC VVIP” is an advanced growth system exclusively built for core platform Users by MEXC, relying on the M-Score credit evaluation system. Through the M-Score scoring model, User benefits are categorized into three tiers: Standard, Premier, and Elite. Each tier corresponds to a specific number of exclusive privileges—you may enjoy a certain number of benefits at your current tier, and more privileges will be unlocked when you upgrade to a higher tier. The higher the tier, the more exclusive privileges you are entitled to. |
2.1 M-Score | A dynamic numerical rating generated by MEXC’s proprietary evaluation system based on User authorization. This score evaluates multiple dimensions, including but not limited to: M-Score History (Fulfillment Records): Timeliness of margin additions, compliance with platform rules, repayment of any platform-related obligations, and absence of default records; • Behavioral Patterns: Trading frequency, order execution consistency, asset diversification, platform engagement duration, and adherence to risk management guidelines; • Identity Verification: Completeness of KYC (Know Your Customer) verification, including submission of valid identification documents, proof of residency, and verification of beneficial ownership (for corporate Users); • Asset Holdings: Total asset value in the MEXC account, holding duration of core assets, liquidity of assets, and consistency of asset deposits/withdrawals; • External Data: Relevant information obtained from third-party exchanges, financial institutions, or credit bureaus (with User authorization), including fulfillment records and transaction history; • Compliance Status: Absence of administrative penalties, court judgments, or enforcement orders; adherence to anti-money laundering (AML) and counter-terrorist financing (CTF) requirements; and no history of malicious behavior (e.g., fraud, market manipulation). • Activity Participation: Points obtained by participating in designated platform activities. The M-Score is updated daily based on new data and calculated on a T+1 basis and may be adjusted due to changes in User behavior, market conditions, or regulatory requirements. |
2.2 Service Page | The systems and interfaces through which M-Score Services are provided, including but not limited to websites, software clients (Apps), API integrations, and mini-programs. You acknowledge that functionalities may vary across different interfaces due to technical constraints or operational requirements. MEXC may update the Service Page’s design, features, and layout from time to time, with or without prior notice, to improve user experience and service quality. |
2.3 Negative M-Score Information | Any data that may adversely affect your M-Score, including but not limited to: • Default Records: Failure to add margin as required within the time limit, failure to properly perform obligations when participating in platform activities or Services, posting inappropriate or malicious remarks on the platform, intentionally providing false documents and information, engaging in fraudulent transactions, or manipulating market prices; • Legal Disclosures: Administrative penalties, court judgments, or enforcement orders against the User; violations of AML/CTF regulations; or involvement in illegal financial activities; • Other Adverse Acts: Any other behavior deemed by MEXC to negatively impact the User’s risk profile or credit worthiness, including but not limited to excessive withdrawal of assets, frequent account login from high-risk regions, or association with suspended/terminated MEXC accounts. |
3. M-Score SCORING SYSTEM
3.1 M-Score Evaluation
You acknowledge that your eligibility for certain benefits is determined by MEXC’s proprietary M-Score scoring model and at MEXC’s sole discretion. This model evaluates a wide range of data points, including but not limited to:
- Trading Volume: trading value (Spot and Futures) based on historical records, with higher and more consistent volume positively impacting the score;
- Asset Holding Duration: The average holding period of assets in your account (longer holding periods for stable assets indicate lower risk and may increase the score);
- Repayment History: Timeliness of margin additions, compliance with loan repayment obligations (if applicable), and absence of default events;
- Platform Engagement: Frequency of account login, participation in platform activities, completion of M-Score-building tasks, and submission of feedback;
- Identity Verification Completeness: Full completion of KYC Level 1, Level 2, and (for corporate Users) beneficial ownership verification;
- External Data: fulfillment records, transaction history, and M-Score-related information obtained from third-party exchanges or financial institutions (with your explicit authorization, as detailed in Section 5);
- Compliance Record: Adherence to MEXC’s User Agreement, Privacy Policy, and applicable laws and regulations (e.g., AML/CTF requirements). MEXC may adjust the weight of each evaluation criterion from time to time based on market conditions, regulatory requirements, and service optimization needs.
- Activity Participation: The status of M-Score points obtained by participating in designated platform activities.

You acknowledge that the M-Score scoring model is proprietary to MEXC and that the specific weightings and algorithms are confidential, except as required by law to disclose to competent authorities.
3.2 Dynamic Adjustment
MEXC reserves the right to adjust your M-Score and associated benefits at any time based on the following factors, without prior notice:
- Changes in your platform behavior (e.g., increased default risk, fraudulent activity, or non-compliance with platform rules);
- Updates to the M-Score scoring model (including adjustments to evaluation criteria or weightings);
- Market volatility or economic conditions that increase systemic risk;
- Changes in regulatory requirements;
- Receipt of adverse external data (e.g., negative fulfillment records from third-party exchanges or legal penalties);
- Deterioration in your financial situation (as indicated by asset withdrawals, low account balance, or inconsistent trading activity). M-Score increases are typically based on sustained positive behavior over time, and completing designated tasks can accelerate score growth. You may view your current M-Score and a summary of key influencing factors on the Service Page. MEXC may provide a general explanation of score changes (e.g., “Score increased due to consistent trading volume”) but will not disclose detailed algorithmic information.
3.3 Confidentiality of Scoring Model & User Remedies
MEXC’s proprietary M-Score scoring model is a proprietary asset and valuable intellectual property of MEXC. Under no circumstances will MEXC disclose any underlying code, algorithmic logic, or detailed weightings of evaluation criteria in response to User requests, unless such disclosure is required by law to be provided to competent authorities or judicial organs. If You are dissatisfied with the M-Score evaluation result (e.g., a sudden score decrease or denial of benefits), You may submit a written request for re-evaluation to MEXC’s M-Score Service Team within [15] calendar days of becoming aware of the result. Your request must include: (i) your MEXC account ID; (ii) a detailed explanation of why you believe the evaluation is incorrect; (iii) any supporting documentation (e.g., proof of timely margin addition, evidence of compliance with platform rules). MEXC will review your request within [30] calendar days and notify you of the re-evaluation result. The re-evaluation result is final and binding. Alternatively, You may choose to terminate the Services in accordance with Section 8 of this Agreement if you disagree with the evaluation result.
4. DATA SHARING
4.1 Cross-Platform M-Score Data Sharing and Acquisition
To enhance the integrity of the industry M-Score ecosystem, improve the accuracy of MEXC’s M-Score evaluation model, and provide Users with consistent M-Score services across platforms, you hereby explicitly authorize MEXC to:
- Share your M-Score and corresponding tier rating (excluding the underlying basis and raw data supporting the M-Score and rating) with MEXC’s strategic partners, affiliated exchanges, and third-party financial institutions (collectively, “Third-Party Partners”) where applicable;
- Currently, MEXC does not engage in collecting M-Score-related data from Third-Party Partners, and any future adjustments to this practice may be notified to you separately.
4.2 Purpose of Data Sharing and Acquisition
The sharing and acquisition of M-Score-related data pursuant to Section 4.1 are intended for the following purposes:
- To improve MEXC’s proprietary M-Score scoring model by incorporating external data (e.g., fulfillment records from third-party exchanges) to ensure more accurate and comprehensive M-Score evaluation;
- To re-evaluate and adjust your M-Score and associated benefits based on a holistic view of your credit worthiness (including both on-platform and off-platform behavior);
- To provide reciprocal benefits on Third-Party Partner platforms (e.g., recognizing your M-Score for eligibility for similar M-Score services on partner exchanges);
- To enhance cross-platform risk management and fraud prevention (e.g., identifying Users with a history of default or fraud across multiple platforms);
- To promote platform events and collaborative services between MEXC and Third-Party Partners (e.g., exclusive joint promotions for Users with high M-Scores).
MEXC will not use data acquired from Third-Party Partners for any purpose other than those specified above, unless additional authorization is obtained from you. You acknowledge that the accuracy of data acquired from Third-Party Partners is the responsibility of the originating party, and MEXC may use reasonable efforts to verify such data but does not guarantee its completeness or correctness
4.3 Data Sharing Limitations and Security Measures
MEXC shall implement the following limitations and security measures to protect your M-Score-related data when sharing or acquiring it from Third-Party Partners (if any):
- Data Minimization: MEXC will only share or acquire the minimum amount of data necessary to achieve the purposes specified in Section 4.2. For example, MEXC may share your M-Score but will not disclose your full transaction details or personal identification information (e.g., passport number) unless required by law;
- Anonymization/Pseudonymization: Where possible, MEXC will anonymize or pseudonymize your data before sharing it with Third-Party Partners (e.g., using a unique identifier instead of your real name) to reduce the risk of re-identification;
- Contractual Obligations: MEXC will enter into written agreements with all Third-Party Partners that require them to: (i) use your data only for the specified purposes; (ii) implement adequate technical and organizational security measures to protect the data; (iii) not share your data with any other parties without MEXC’s prior written consent; (iv) comply with applicable data protection laws;
- Security Assessments: MEXC will conduct regular security assessments of Third-Party Partners to ensure they maintain adequate data protection standards. If a Third-Party Partner fails to meet these standards, MEXC will suspend or terminate the data sharing arrangement;
- User Control: You may withdraw your authorization for MEXC to share your data with Third-Party Partners at any time by contacting MEXC. However, withdrawing this authorization may result in the suspension or termination of certain M-Score Services benefits (e.g., reciprocal benefits on partner platforms) and may limit MEXC’s ability to re-evaluate your M-Score using external data. Withdrawal of authorization will not affect data sharing that has already occurred prior to the withdrawal.
5. GENERAL TERMS
5.1 Obligation to Protect and Use M-Score Properly
You shall properly safeguard Your M-Score, and related credit information. You agree to:
- Not disclose your M-Score to third parties for fraudulent or unauthorized purposes (e.g., allowing another User to use your M-Score to access premium services);
- Not attempt to artificially manipulate, inflate, or tamper with your M-Score through any improper means, including but not limited to: (i) creating fake accounts to simulate trading volume; (ii) submitting false documents or information to improve your identity verification status; (iii) colluding with other Users to engage in sham transactions; (iv) hacking or otherwise interfering with MEXC’s M-Score scoring system;
- Immediately notify MEXC if you become aware of any unauthorized use of your M-Score;
- Comply with all applicable laws and regulations when using your M-Score or related benefits.
If MEXC determines that you have violated this Agreement, MEXC may take one or more of the following actions: (i) reduce your M-Score; (ii) revoke your M-Score Services benefits; (iii) suspend or terminate your M-Score Services; (iv) terminate your overall MEXC account; (v) pursue legal remedies for any losses incurred by MEXC.
5.2 Incorporation of MEXC Exchange Terms
By subscribing to M-Score, You acknowledge that, to the extent applicable to your MEXC account(s), ALL TERMS AND AGREEMENTS OF MEXC EXCHANGE ARE HEREBY INCORPORATED INTO THIS AGREEMENT, including but not limited to:
- MEXC User Agreement (governing general platform use, account management, and dispute resolution);
- MEXC Privacy Policy (governing the collection, use, storage, and disclosure of your personal data);
- MEXC Risk Disclosure Statement (governing risks associated with digital asset trading);
- MEXC Margin Trading Rules (governing margin requirements, liquidation, and leverage use);
- Arbitration and Class-Action Waiver Provisions (governing the resolution of disputes between you and MEXC).
In the event of a conflict between this Agreement and the incorporated terms, this Agreement shall prevail with respect to matters specifically related to M-Score Services. For all other matters, the incorporated terms shall prevail.
5.3 Governing Law and Dispute Resolution
This Agreement is governed by, and all disputes arising out of or in connection with this Agreement shall be subject to, the applicable “Governing Law and Dispute Resolution” provisions of the MEXC User Agreement.
5.4 Supplemental Terms
You may, in the future, receive supplemental disclosures, terms, and agreements that pertain to certain account types, features, or services within M-Score (e.g., updated leverage tiers, new M-Score Seed redemption options, or specialized services for institutional Users). These supplemental terms shall be deemed part of this Agreement and shall be binding on you upon notification (via email, in-app message, or posting on the Service Page). You are responsible for reviewing any supplemental terms and continuing to use the Services shall constitute your acceptance of such terms.
5.5 Amendments
MEXC may supplement or amend this Agreement and its terms from time to time (including but not limited to changes to benefits, M-Score scoring criteria, data sharing rules, or risk disclosure) by providing notice to You through one or more of the following channels: (i) email to your registered email address; (ii) in-app notification on the MEXC Platform; (iii) posting the revised Agreement on the Service Page or MEXC’s Legal Documents page. The amendments will become effective upon the effective date specified in the notice. By continuing to use the M-Score Services after the effective date of the revised Agreement, you are deemed to have accepted the terms of the revised Agreement and will be legally bound thereby. If you do not agree to the revised Agreement, you must cease using the Services and terminate your M-Score account in accordance with Section 8 of this Agreement.
6. DATA PROTECTION AND PRIVACY
6.1 Scope of Data Protection
This Section supplements MEXC’s Privacy Policy and sets forth additional data protection requirements specific to M-Score Services. MEXC shall comply with applicable data protection laws (e.g., GDPR, CCPA, Personal Data Protection Act) when collecting, using, storing, sharing, and transferring your personal data and M-Score-related data (collectively, “User Data”) in connection with the M-Score Services. User Data includes all information collected pursuant to this Agreement, including but not limited to:
- Personal Identification Data: Full legal name, email address, phone number, passport number, driver’s license number, proof of residency, and other information provided during KYC verification;
- Financial Data: Bank account information, payment card details, account assets, transaction history, trading data, tax identification number, and M-Score information;
- M-Score-Related Data: M-Score information, compliance records, and data acquired from Third-Party Partners (as specified in Section 5);
- Device Data: Carrier, brand, software version, model name, IMEI, IDFA, MAC address, IP address, and other device-related information collected when accessing the Service Page.
6.2 User Rights Relating to User Data
Pursuant to applicable data protection laws and MEXC’s Privacy Policy, you have the following rights with respect to your User Data, which may be exercised by contacting MEXC’s Data Protection Officer via email at [dataprotect@support.MEXC.com]: • Right to Access: You have the right to request confirmation that your User Data is being processed and to obtain a copy of your User Data, along with information about the purposes of processing, categories of data processed, and recipients of the data; • Right to Rectification: You have the right to request the correction of inaccurate or incomplete User Data. You may also update certain User Data (e.g., contact information) directly through the Service Page; • Right to Erasure (“Right to be Forgotten”): In certain circumstances (e.g., the data is no longer needed for the purposes for which it was collected, you withdraw your consent, or processing is in violation of applicable law), you have the right to request the erasure of your User Data. However, MEXC may retain certain data if required by law (e.g., AML/CTF record-keeping requirements) or for legitimate business purposes (e.g., resolving disputes); • Right to Restrict Processing: You have the right to request the restriction of processing of your User Data if: (i) you contest the accuracy of the data; (ii) processing is unlawful but you do not want the data erased; (iii) MEXC no longer needs the data but you require it for legal claims; or (iv) you have objected to processing pending a decision by MEXC; • Right to Data Portability: You have the right to receive your User Data in a structured, commonly used, and machine-readable format (e.g., CSV, JSON) or to request that MEXC transmit the data directly to another data controller (e.g., another exchange), where technically feasible; • Right to Object: You have the right to object to the processing of your User Data for direct marketing purposes or where processing is based on MEXC’s legitimate interests (unless MEXC can demonstrate compelling legitimate grounds for processing that override your interests, rights, and freedoms); • Right to Withdraw Consent: You have the right to withdraw your consent to processing of your User Data (e.g., consent to data sharing with Third-Party Partners) at any time. Withdrawal of consent shall not affect the lawfulness of processing based on consent before the withdrawal. MEXC will respond to your data subject rights request within [30] calendar days of receipt. If the request is complex or requires additional information, MEXC may extend the response period by up to [60] days, and will notify you of the extension within the initial [30] days. MEXC may charge a reasonable fee for excessive or unfounded requests, as permitted by applicable law.
6.3 Data Storage and Retention
MEXC shall store your User Data on secure servers operated by MEXC or its authorized service providers. User Data may be stored in countries outside of your jurisdiction (including but not limited to countries in Asia and Europe) in accordance with MEXC’s Privacy Policy and applicable law. By using the M-Score Services, you consent to the cross-border transfer of your User Data.
MEXC shall retain your User Data for as long as necessary to: (i) provide the M-Score Services to you; (ii) comply with applicable legal obligations; (iii) resolve disputes, enforce this Agreement, and protect MEXC’s legitimate business interests; (iv) maintain the accuracy of your M-Score (e.g., retaining transaction history for [12-24] months to evaluate credit worthiness).
Once the retention period expires or the data is no longer needed for the specified purposes, MEXC shall securely delete or anonymize your User Data to prevent identification. Anonymized data (which cannot be linked to you) may be retained for research and development purposes.
6.4 Cookie Usage in M-Score Services
MEXC uses Cookies and similar tracking technologies (e.g., web beacons, pixel tags) on the Service Page to enhance the M-Score Services and improve user experience. Cookies are small text files stored on your device that collect information about your browsing behavior. The use of Cookies in M-Score Services is subject to MEXC’s Cookie Policy and the following additional terms:
• Types of Cookies Used: MEXC uses the following types of Cookies for M-Score Services: (i) Essential Cookies: Necessary for the operation of the Service Page (e.g., enabling login to your M-Score account); (ii) Performance Cookies: Used to monitor the performance of the Service Page (e.g., tracking page load times, error rates); (iii) Functional Cookies: Used to remember your preferences (e.g., preferred language); (iv) Targeting Cookies: Used to deliver personalized marketing content (e.g., promoting M-Score Services benefits based on your trading behavior).
• Cookie Control: You may manage your Cookie preferences through your browser settings (e.g., block non-essential Cookies). However, disabling essential Cookies may prevent you from accessing certain features of the M-Score Services (e.g., logging in to your M-Score account).
• Cookie Retention: Cookies used for M-Score Services shall be retained for a maximum period of [12] months, unless you delete them earlier through your browser settings.
6.5 Security Measures for User Data
MEXC shall implement appropriate technical and organizational security measures to protect your User Data from unauthorized access, use, disclosure, alteration, or destruction. These measures include but are not limited to:
• Encryption: Encryption of User Data in transit (using TLS/SSL) and at rest (using AES-256 encryption);
• Access Controls: Restricting access to User Data to authorized MEXC personnel and third-party service providers who have a legitimate need to process the data. Access is granted based on the principle of least privilege (i.e., only the minimum access necessary to perform job functions);
• Security Audits: Conducting regular security audits and penetration testing of MEXC’s systems and the Service Page to identify and address vulnerabilities;
• Employee Training: Providing regular training to MEXC employees on data protection laws, security best practices, and the proper handling of User Data;
• Incident Response Plan: Maintaining a data breach incident response plan to promptly detect, contain, and remediate data breaches. In the event of a data breach that poses a risk to your rights and freedoms, MEXC shall notify you and the relevant supervisory authority (as required by applicable law) without undue delay;
• Third-Party Security: Requiring third-party service providers (e.g., server hosting providers, data analytics firms) to implement equivalent security measures and conduct regular security assessments.
Despite these measures, MEXC cannot guarantee absolute security of your User Data, as no data transmission or storage system is 100% secure. You agree that MEXC shall not be liable for any unauthorized access, use, or disclosure of User Data resulting from circumstances beyond MEXC’s reasonable control (e.g., hacking attacks, malware, or user error).
6.6 Compliance with Privacy Policy
All processing of User Data in connection with the M-Score Services shall comply with MEXC’s Privacy Policy. In the event of any inconsistency between this Section 6 and MEXC’s Privacy Policy, this Section 6 shall prevail with respect to matters specific to the M-Score Services. For all other matters, MEXC’s Privacy Policy shall apply. You acknowledge that you have read and understood MEXC’s Privacy Policy and consent to the processing of your User Data as described therein and in this Agreement.
7. TERMINATION
7.1 Termination by You
You may terminate your M-Score account and this Agreement at any time by submitting a written request to MEXC’s M-Score Service Team via email at service@support.MEXC.com. To process the termination, you must provide your MEXC account ID and verify your identity (e.g., by providing a copy of your identification document or answering security questions).
7.2 Termination by MEXC
MEXC may terminate this Agreement and your M-Score account at any time, with or without prior notice, if:
- You violate any term of this Agreement, the MEXC User Agreement, Privacy Policy, or other incorporated legal documents;
- Your MEXC account is suspended or terminated for any reason; • You provide false or misleading information to MEXC (e.g., during KYC verification or M-Score evaluation);
- Your M-Score falls below the minimum threshold for eligibility (e.g., [300] points) and remains below that threshold for [3] consecutive months;
- You engage in fraudulent, illegal, or unethical behavior in connection with the M-Score Services (e.g., manipulating your M-Score, defaulting on margin obligations, or engaging in market manipulation);
- MEXC discontinues the M-Score Services or ceases operations in your jurisdiction;
- Compliance with applicable law or regulatory requirements requires MEXC to terminate the Agreement (e.g., a change in leverage regulations that makes the M-Score Services unavailable to you). Upon termination by MEXC, the same consequences as set forth in Section 7.1 shall apply. MEXC shall not be liable to you for any damages resulting from termination of the Agreement in accordance with this Section 7.2.
7.3 Effect of Termination
Upon termination by either you or MEXC:
- You will lose access to all M-Score Services benefits (e.g., enhanced leverage, fee discounts, exclusive research);
- Your M-Score will be deactivated and no longer updated;
- MEXC will cease sharing your M-Score-related data with Third-Party Partners (but will not request the deletion of data already shared with them, unless required by law);
- Your MEXC account (if any) will remain active, but you will no longer be eligible for M-Score Services-related features.
Termination of this Agreement does not affect any rights or obligations that accrued prior to termination (e.g., liability for losses incurred due to liquidation, payment of outstanding fees).
7.4 Survival of Terms
Sections of this Agreement that by their nature should survive termination shall remain in effect, including but not limited to:
- Data protection and privacy obligations (Section 6);
- Governing law and dispute resolution (Section 5.3);
- Liability limitations and indemnification (if applicable);
- Any rights or obligations that accrued prior to termination.
8. LIABILITY AND INDEMNIFICATION
8.1 Limitation of Liability
MEXC shall not be liable to you for any direct, indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profits, loss of assets, loss of data, or business interruption) arising out of or in connection with the M-Score Services, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if MEXC has been advised of the possibility of such damages.
MEXC’s total liability to you for any claims arising out of this Agreement shall not exceed the total fees paid by you to MEXC in connection with the M-Score Services during the [12] months preceding the claim. This limitation of liability shall not apply to: (i) damages caused by MEXC’s gross negligence or willful misconduct; (ii) fraud or misrepresentation by MEXC; (iii) liability for personal injury or death; (iv) any other liability that cannot be limited by applicable law.
8.2 Indemnification
You agree to indemnify, defend, and hold harmless MEXC, its affiliates, directors, officers, employees, agents, and third-party service providers from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or in connection with:
- Your use of the M-Score Services;
- Your violation of this Agreement, the MEXC User Agreement, Privacy Policy, or other incorporated legal documents;
- Your violation of applicable laws, regulations, or the rights of any third party (including other Users or Third-Party Partners);
- Your fraudulent, illegal, or unethical behavior in connection with the M-Score Services;
- Any loss or damage caused by your failure to protect your MEXC account or M-Score-related information (e.g., password, M-Score).
MEXC shall notify you of any such claim and shall have the right to participate in the defense of the claim with counsel of its choice. You shall not settle any claim without MEXC’s prior written consent.
9. MISCELLANEOUS
9.1 Notices
All notices, communications, and other information required or permitted under this Agreement shall be in writing and delivered to you via: (i) email to your registered email address; (ii) in-app notification on the MEXC Platform; or (iii) posting on the Service Page or MEXC’s Legal Documents page. Notices shall be deemed received by you on the date of transmission (for email and in-app notifications) or the date of posting (for notices on the platform).
9.2 Severability
If any provision of this Agreement is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that achieves the closest possible purpose to the original provision.
9.3 Waiver
No failure or delay by MEXC in exercising any right, power, or remedy under this Agreement shall operate as a waiver thereof, nor shall any single or partial exercise of such right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.
9.4 Assignment
You may not assign or transfer this Agreement or any of your rights or obligations herein without MEXC’s prior written consent. MEXC may assign or transfer this Agreement to any affiliate or third party without your consent.
9.5 Entire Agreement
This Agreement, together with the incorporated legal documents (MEXC User Agreement, Privacy Policy, Risk Disclosure Statement, M-Score service description documents, function implementation specifications, participation eligibility criteria, and activity introductions, etc.), constitutes the entire agreement between you and MEXC with respect to the M-Score Services and supersedes all prior or contemporaneous agreements, understandings, and communications (whether written or oral) between you and MEXC relating to the subject matter hereof.
9.6 Force Majeure
MEXC shall not be liable for any failure or delay in performing its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to: natural disasters (earthquakes, floods, hurricanes), wars, riots, strikes, government actions (e.g., bans, sanctions), technical failures (server outages, internet disruptions), or shortages of materials or services. MEXC shall notify you of the force majeure event and shall use reasonable efforts to resume performance as soon as possible.

10. ACCEPTANCE
By enabling M-Score or using MEXC’s M-Score Services and related trading services, You acknowledge that:
- You have read, understood, and reviewed this Agreement and all incorporated disclosures, terms, and agreements (including the MEXC User Agreement, Privacy Policy, and Risk Disclosure Statement);
- You are of legal age to enter into this Agreement (at least [18] years old, or the age of majority in your jurisdiction);
- You have the legal capacity to use the M-Score Services and comply with this Agreement;
- You agree to subscribe to M-Score Services and be bound by all of the terms and conditions set forth herein;
- You acknowledge the risks associated with using M-Score services, high leverage, and digital asset trading, and you accept full responsibility for any losses that may occur;
- You explicitly authorize MEXC to share and acquire your M-Score-related data as specified in Section 5 of this Agreement;
You have reviewed MEXC’s Privacy Policy and understand how your personal data and M-Score-related data will be collected, used, stored, and disclosed.
