Fiscalía francesa pide condena para Airbus y Air France por accidente que dejó 228 muertos

La Fiscalía General de Francia solicitó el miércoles una condena para el fabricante europeo Airbus y la aerolínea Air France, juzgados en apelación por homicidio involuntario tras el accidente del vuelo Rio-París en 2009 que dejó 228 muertos.

Air France y Airbus fueron absueltos en primera instancia en abril de 2023, cuando el tribunal correccional de París demostró que, aunque se cometieron "imprudencias" y "negligencias", "no se pudo demostrar (...) ningún vínculo causal seguro" con el accidente más mortal en la historia de las aerolíneas francesas.

"Solicitamos la revocación de la sentencia que absolvió a los acusados y, por lo tanto, señora presidenta, le pedimos que dicte sentencia condenatoria por homicidio involuntario", declararon los dos fiscales generales en su alegato, calificando de "indecente" la línea de defensa de las dos empresas durante el juicio en el tribunal de apelación de París.

El 1 de junio de 2009, el Airbus que partió de Río de Janeiro hacia París (vuelo AF447) se estrelló en plena noche en el Atlántico, pocas horas después de su despegue, provocando la muerte de sus 216 pasajeros y 12 miembros de la tripulación. A bordo del A330 había personas de 33 nacionalidades, entre ellas 72 franceses y 58 brasileños.

Las cajas negras confirmaron el origen del accidente: la congelación de las sondas de velocidad Pitot mientras el avión volaba a gran altura en una zona meteorológica difícil cerca del ecuador.

El juicio en apelación, que comenzó a finales de septiembre, debe terminar el 27 de noviembre.

"Esta condena arrojará el oprobio, un descrédito sobre estas dos empresas. Es una decisión que volverá a situar lo humano en el centro de nuestras preocupaciones. Por lo tanto, esta condena debe resonar como una advertencia", dijo el fiscal general Rodolphe Juy-Birmann, junto a su colega Agnès Labreuil.

En una sala llena y especialmente silenciosa, las familias de las víctimas escucharon durante casi cinco horas el alegato final, al término del cual Juy-Birmann quiso dirigirse directamente a ellas.

"Han pasado dieciséis años desde la tragedia, es mucho tiempo, demasiado tiempo. Nos impresionó saber que han estado ahí cada día, tan cerca de nosotros, lo que da sentido a nuestra misión. Espero que su lucha termine cuando el tribunal dicte su sentencia dentro de unos meses", declaró.

Air France está acusada de no haber impartido a los pilotos una formación adecuada sobre situaciones de congelación de las sondas Pitot, que miden la velocidad del avión en el exterior, y por no haber informado suficientemente a sus tripulaciones.

Airbus se enfrenta a acusaciones de haber subestimado la gravedad de los fallos de las sondas anemométricas y no haber tomado todas las medidas necesarias para informar con urgencia a las compañías aéreas que las utilizan.

Cada una de las empresas se expone a una multa de 225,000 euros (263,000 dólares).

La acusación reconoció en su alegato que sin importar la pena, esta será "insignificante frente a la tristeza de las familias".

Airbus dijo a la AFP que "tomó nota de la acusación de la fiscalía de París y responderá en su alegato" el jueves.
