  • xAI, founded by Elon Musk, sues Colorado to block Senate Bill 24-205 on AI regulation.
  • The company claims the law restricts Grok’s free expression and “truth-seeking” goal.
  • The case adds to the wider US debate on federal vs state AI rules.

Elon Musk’s AI company xAI has reportedly filed a lawsuit against the US state of Colorado. The suit challenges a new law introduced by the state to regulate how AI chatbots communicate.

xAI argues that Colorado’s rules could limit free expression and interfere with how its chatbot Grok delivers responses. The company added that the rule could restrict its mission of building a “truth-seeking” AI system.

xAI by Elon Musk Sues Colorado over AI Rules

According to the latest report, xAI, the company owned by tech billionaire Elon Musk, has sued the US state of Colorado. The lawsuit, filed on Thursday, aims to block the state’s Senate Bill 24-205 from coming into effect.

Reportedly, the bill intends to reduce “algorithmic discrimination” in AI systems used in sensitive areas, such as hiring, housing, banking, and employment decisions.

But xAI argues that the legislation goes too far by trying to control how AI models like Grok generate and deliver responses. According to the company, this amounts to government interference in how its chatbot communicates with users.

xAI’s court filing states, “Colorado cannot alter xAI’s message simply because it wants to amplify its own views on the highly politicized subjects of fairness and equity.”  The filing added that it would hinder its mission to make Grok a “maximally truth-seeking.”

It is worth noting that this development comes on the heels of X’s launch of labeled paid crypto promotions. Elon Musk intends to promote crypto-related sponsored posts on his X platform.

Elon Musk Pushes Back Against Colorado AI Law Over Chatbot Speech

According to the AI company owned by Elon Musk, the Colorado law is inconsistent in how it defines fairness. Although it claims to be designed to stop discrimination, it could still end up allowing “differential treatment” in certain cases.

It is worth noting that this is not the first time Elon Musk has pushed back against AI regulations. The platform brought forth a case in December 2025 against California on the basis of a statute that mandated that AI companies be obliged to disclose data used in training their models.

According to Elon Musk, such mandates would mean that companies would be forced to divulge trade secrets and infringe upon their right to free speech.

Thus, the current lawsuit filed by Elon Musk’s company highlights the growing friction between AI platforms and governments. While authorities continue to introduce new rules, the AI companies claim that they are restricting innovation.

David Sacks Calls for Unified Federal AI Regulation

Amid this growing scrutiny, White House’s David Sacks has called for a unified national approach to AI regulation. He warned that individual state laws could create confusion for AI-based companies. He believes the US should adopt a single, clear federal standard for artificial intelligence.

Sacks has described the current situation as a “patchwork” of regulations, in which different states are introducing AI laws with varying requirements. According to him, this makes it harder for innovators and tech companies to build and launch AI products smoothly across the country.

He noted, “The problem that we’re seeing right now is that you’ve got 50 different states regulating this in 50 different ways, and it’s creating a patchwork of regulation that’s difficult for innovators to comply with.”
