Habba said she is stepping down from her role as a result of a ruling from the Third Circuit Court of Appeals, which found last month that “only the first assistant in place at the time the vacancy arises automatically assumes the functions and duties of the office.” Habba said she will serve as a senior adviser to Attorney General Pam Bondi, who said she was “saddened to accept” Habba’s resignation.
