The man accused of planting the pipe bombs outside the Republican and Democratic National Committee headquarters on Jan. 6 is arguing in court that President Donald Trump's blanket pardon of MAGA rioters applies to him — but federal prosecutors disagree.
According to Meidas Touch's Scott MacFarlane, prosecutors made a filing on Friday seeking the rejection of Brian Cole, Jr.'s motion to dismiss for lack of jurisdiction.
"The defendant claims that his planting pipe bombs outside the headquarters of the major political parties on the night of January 5, 2021, is conduct for which he was preemptively pardoned under President Trump's January 20, 2025, presidential proclamation concerning the events of January 6, 2021," said the filing. "The defendant ignores that the proclamation expressly limited relief to individuals who had been 'convicted of,' or had a 'pending indictment' for, offenses related to the events at or near the United States Capitol on January 6. On January 20, 2025, the defendant belonged to neither category, and so the proclamation has no bearing on this case."
"Moreover, the defendant's January 5 offenses were not, as the proclamation required, 'related to' events at or near the United States Capitol 'on January 6,'" the prosecutors continued. "And even if the proclamation somehow could apply to this case, the Department of Justice's contrary position is entitled to deference as a reasonable interpretation taken by the Executive Branch agency expressly charged with administering the proclamation."
"Any one of these independent grounds is sufficient to deny the motion," the prosecutors wrote. "The Court should rely on all three."
This comes around two weeks after federal prosecutors moved for a contempt of court judgment against Cole's attorney for doxing a Capitol Police officer whom numerous people in right-wing internet circles initially falsely identified as the suspect.
The White House is lashing out at Rep. Jamie Raskin (D-MD) after he sent a letter to President Donald Trump's doctor demanding he submit to cognitive screening, according to MS NOW's Mychael Schnell.
"Lightweight Jamie Raskin is a stupid person’s idea of a smart person," stated White House spokesperson Davis Ingle. "President Trump’s sharpness, unmatched energy, and historic accessibility stand in stark contrast to what we saw during the past four years when Democrats like Raskin intentionally covered up Joe Biden’s serious mental and physical decline from the American people."
This follows a letter sent by Raskin, the ranking member of the House Judiciary Committee, to Cpt. Sean Barbabella, the White House physician, expressing concern that Trump's erratic behavior surrounding the Iran war could be a sign of mental decline — and citing concerns from some of Trump's former allies, including former Rep. Marjorie Taylor Greene (R-GA) that he has "gone insane," as well as concerns from Rep. James Comer (R-KY) about former President Joe Biden's mental fitness.
"Experts have repeatedly warned that the President has been exhibiting signs consistent with dementia and cognitive decline," wrote Raskin. "And, in recent days, the country has watched President Trump's public statements and outbursts turn increasingly incoherent, volatile, profane, deranged, and threatening. His apparently deteriorating condition has caused tremendous alarm across the nation (and political spectrum) about the President's cognitive function and continuing mental fitness for the office of President, and prompted concerns about the President's well-being."
"On October 2025, you issued a statement declaring that the President 'continues to demonstrate excellent overall health,'" wrote Raskin. "In light of the President's extreme behavior over the past week to say nothing of his conduct in office more broadly-the public must know whether you still stand by that assessment. As Republican congressional leaders have repeatedly said, the American people deserve to know whether our President is mentally capable of making the life- or-death decisions that his office demands."
Trump has denied any issues with his mental acuity, repeatedly insisting that he has "aced" the Montreal Cognitive Assessment (MoCA) — even though passage of this test does not rule out mental decline.

New York Times reporter and CNN contributor Lulu García-Navarro suggested that First Lady Melania Trump's Thursday statement denying connections to Jeffrey Epstein raised more questions than it answered.
García-Navarro questioned the timing of the public statement, noting it made no political sense and appeared inconsistent with her typical public profile.
Melania mentioned her upcoming book in the statement, which García-Navarro found "a little strange."

President Donald Trump on Friday blasted former Fox News host Tucker Carlson, claiming his endorsement helped doom a Republican challenger in South Carolina’s Senate race.
In a post to his Truth Social followers, Trump reacted to news that Paul Dans – a conservative operative and former director of the controversial Project 2025 initiative – had dropped out of the GOP primary contest against MAGA ally Sen. Lindsey Graham (R-SC).
“Paul Dans has just dropped out of the South Carolina Senatorial Race against the Great Lindsey Graham,” Trump wrote of Dans, who served in his first administration. “It all started to fall apart for Paul when a very Low IQ individual named Tucker Carlson ENDORSED him — THE KISS OF DEATH!”
Trump went on to praise Graham, who he said has “a BIG lead, and is on his way to a spectacular VICTORY.”
“He just, GETS THINGS DONE!” Trump added.
In a separate post minutes earlier, Trump also took aim at another Republican candidate in the South Carolina race, calling Mark Lynch “a lunatic.”
“Mark Lynch would be a DISASTER for the Republican Party,” the president wrote Friday, as he urged voters to back Graham, writing: “Lindsey Graham just, GETS THE JOB DONE. VOTE FOR LINDSEY ALL THE WAY. MAGA!”
Trump also slammed Lynch for supporting Rep. Thomas Massie (R-KY), whom the MAGA leader proclaimed as “the Worst Congressman in the History of our Country.”
