MAGA Congressman Max Miller (Ohio) is being accused of beating the mother of his 2-year-old daughter in front of her in an incident that unfolded on Feb. 1 of this year.
According to court filings uncovered by the Daily Mail and three sources cited by the website, Miller's ex-wife Emily Moreno sought changes to their custody agreement after concerns over his “dangerous physical behavior” in their daughter’s presence.
Moreno, the daughter of Ohio Sen. Bernie Moreno (R) alleged in the filing that Miller "struck her during a custody exchange at his home in full view of the couple’s 2-year-old daughter, leaving bruises on her arm, elbow, and torso," the report said.
Photos obtained by the Daily Mail show bruising and redness on her body after the alleged incident.
The Bay Village Police Department confirmed that they responded to a report of child abuse that day, but did not say whether it was the Miller/Moreno encounter. They wouldn't give further information other than to say that the investigation remains open, said the DailyMail.
In June 2024, Moreno alleged that Miller threw a pot of boiling water at her. The water hit her chest, causing redness that was also shown in the photos. The incident also occurred in the presence of their daughter.
The couple then began divorce proceedings and reached a settlement in June 2025, where they would agree to share custody of their daughter. Miller would provide $2,500 per month in child support.
An April TMZ report cited a claim from Moreno that Miller “regularly speaks to me in an inappropriate, aggressive and demeaning manner, which is not in the best interest of our child.”
She also alleged that Miller “has conducted dangerous physical behavior in the child’s presence.”
“I do not believe it is in our child’s best interest for [Miller] and me to jointly make a decision for her,” Moreno added, saying she feared it would "cause direct harm" to their child.
Miller previously wrote a letter to Moreno after the alleged boiling-water incident, in which he apologized but didn't admit any culpability. He called himself worthless and claimed guilt was "eating him alive," the letter reviewed by the DailyMail said.
“I don’t know what to do. I do know you love me, protect me and care for me. I failed to do that for you,” Miller allegedly wrote. “I’m sorry and I just want to close my eyes and wake up and everything be normal.”
“I know that won’t happen,” the letter continues. “I’m sorry I failed you and Ruth. It’s eating me alive. I love you, even if you think I don’t. I love you so much. I’m so sorry. I’m just a f—— up and worthless.”
“These images, combined with the documented history in court filings, directly contradict years of Mr. Miller’s denial,” said Moreno’s attorney, Andrew Zashin. “Any claim that Ms. Moreno fabricated these allegations collapses in the face of contemporaneous physical evidence.”
“It is unfortunate that these matters have become public when Ms. Moreno has made every effort to keep them private and out of court for the sake of their daughter,” he added. “But the ongoing pattern of behavior, coupled with the continued denials, has made silence no longer possible.”
Miller is up for relection in November. He will face Democrat Brian Poindexter. Donald Trump won the district in 2024 by 11 points (55-44).
