In a sharp escalation of tensions with Washington, AI firm Anthropic has filed an anthropic lawsuit over its sudden blacklisting by the US defense establishment.

Anthropic sues Pentagon over “supply chain risk” label

Anthropic filed two lawsuits on Monday against the Department of Defense (DoD), arguing that the government’s decision to brand the company a “supply chain risk” is unlawful and violates its First Amendment rights. The dispute has simmered for months, as the firm sought safeguards limiting military use of its AI for mass domestic surveillance or fully autonomous lethal weapons.

The new cases, lodged in the northern district court of California and the US court of appeals for the Washington DC Circuit, follow the Pentagon’s formal issuance of the risk designation last Thursday. Over the past year, Anthropic’s flagship AI model Claude has become deeply integrated into the Department of Defense. The DoD has allegedly used the system extensively in military operations, including helping decide where to target missile strikes in its war against Iran.

Anthropic stressed in its filings that it remains committed to providing AI for national security purposes. Company seeks both court review and continued dialogue

The firm insists that seeking judicial review does not signal a retreat from defense work. Instead, it frames the legal action as a necessary safeguard. In a statement to The Guardian, a spokesperson said: “Seeking judicial review does not change our longstanding commitment to harnessing AI to protect our national security, but this is a necessary step to protect our business, our customers, and our partners.”

Anthropic added that it wants to continue negotiations with the US government despite the litigation. That said, the company has vowed to pursue every possible avenue to resolve the dispute, including further legal action and direct dialogue with federal officials.

Economic harm claims and mixed signals

In its court filings, Anthropic alleges that the Trump administration and Pentagon’s punitive actions are “harming Anthropic irreparably” by cutting it off from critical government-facing business. The company argues that the supply chain risk designation could chill partnerships across the broader defense and technology ecosystem.

However, those claims sit uneasily alongside comments by CEO Dario Amodei in a recent CBS News interview. Last week, Amodei said “the impact of this designation is fairly small” and insisted the company was “gonna be fine.” Observers note that this contrast may become a focal point as the cases move forward.

A test case for AI, national security and speech

Anthropic frames the dispute as a high-stakes clash over innovation and free expression. “Defendants are seeking to destroy the economic value created by one of the world’s fastest-growing private companies, which is a leader in responsibly developing an emergent technology of vital significance to our Nation,” the firm claims in its suit. The anthropic lawsuit also raises broader questions about how Washington will regulate strategic AI vendors.

More broadly, the case is poised to test how far the US government can go in blacklisting an AI company over policy differences about national security AI use. It may also shape future guidance on government censorship claims and the limits of executive power over emerging technology providers.

Pentagon stays silent for now

The Department of Defense did not immediately respond to a request for comment on the filings or its decision-making process. For now, Anthropic’s legal challenge adds a new flashpoint to the debate over how the US should balance security imperatives, civil liberties and the rapid deployment of advanced AI systems inside military and intelligence operations.
