Autoridades están fiscalizando más, pero quieren menos litigios: especialista

La autoridad fiscal quiere menos litigios con los contribuyentes y resolver asuntos fiscales en la fase administrativa con corrección de la situación del contribuyente o bien ä través de acuerdos conclusivos, Juan Manuel Jiménez, socio fundador de Jiménez Illescas Noble & Asociados, una firma jurídica especializada en asuntos fiscales.

Esto durante el “Panel de CEO’s y su visión empresarial” realizado en el Congreso Compliance y Cierre del Ejercicio 2025, organizado por World Integrity & Compliance Forum.

El ponente expuso que, según cifras del Tribunal Federal de Justicia Administrativa (TFJA), actualmente están ingresando al Tribunal un promedio de 12,300 asuntos al mes. Tres años atrás, ingresaban 16,500.

Además, 29% de los asuntos ingresados al TFJA son de materia fiscal contra 51% de hace tres años.

“Hay menos juicios en materia fiscal porque (la autoridad) está apostando a que se llegue a una corrección fiscal, una autocorrección o una autodeterminación, apostarle a los medios alternativos y llegar a acuerdos ante la autoridad fiscal en la Prodecon (Procuraduría de la Defensa del Contribuyente)”, dijo.

En ese sentido, afirmó que la conclusión es que la autoridad quiere menos litigios, que sean menos contenciosos los asuntos y que si bien es cierto que está practicando actos de fiscalización, busca arreglarlos en la fase administrativa, “una negociación legal a través de la corrección fiscal o a través de los acuerdos conclusivos”.

La nueva facultad de verificación exprés de comprobantes fiscales falsos que tendrá el fisco con la reforma al Código Fiscal de la Federación (CFF) y que entrará en vigor el 1 de enero 2026 constituye en los hechos una “facultad de extorsión”, acusó Carlos Orozco Felgueres, director general de Grupo ORFE, un despacho de contadores.

Durante su participación en el mismo foro, el especialista explicó que con la reforma al CFF habrá un nuevo concepto de comprobantes fiscales falsos.

A partir del 1 de enero del 2026 se incorpora el artículo 49 Bis del CFF que dará a la autoridad fiscal la facultad de comprobación exprés, de solo 24 días, cuando sospeche de la existencia de comprobantes fiscales que amparan operaciones inexistentes o simuladas.

En esos 24 días, el fisco va a suspender los certificados de sello digital al contribuyente y lo dejará sin la posibilidad de facturar, lo que podría llevar a la quiebra a muchas empresas a las que sus clientes no les pagarán por la imposibilidad de facturar.
