La Suprema Corte de Justicia de la Nación (SCJN) informó que ejerció su facultad de atracción del expediente 320/2024, relacionado con la cancelación de un crédito fiscal vinculado al pago de Impuesto Sobre la Renta (ISR) por parte de Fomento Económico Mexicano (Femsa) en 2011.

De acuerdo con el expediente, derivado de un análisis al ejercicio fiscal 2011, el 15 de julio de 2021, el Administrador Central de Fiscalización a Grupos de Sociedades de la Administración General de Grandes Contribuyentes del Servicio de Administración Tributaria (SAT) “determinó fincarle a la contribuyente revisada un crédito fiscal por conceptos de ISR por ingresos sujetos a REFIPRES ‘operación bono segregable’ e ISR diferido, respecto del ejercicio fiscal 2011, más sus correspondientes actualizaciones, recargos y multas”.

El 13 de septiembre, Femsa demandó la nulidad del crédito fiscal ante el Tribunal Federal de Justicia Administrativa; la Sala Superior atrajo el asunto y el 12 de junio de 2024, “dictó sentencia donde resolvió declarar la nulidad, lisa y llana, de la resolución determinante de crédito fiscal impugnada”.

Ayer el máximo tribunal del país informó que aceptó la solicitud de atracción y turnó al proyecto a la ministra Lenia Batres Guadarrama.

“Esta determinación no constituye un pronunciamiento sobre el fondo del litigio, sino que su alcance se limita exclusivamente a definir si un asunto debe ser conocido por la SCJN”.
